I certify that the information on this application for credit ("Application") is accurate and I am 21 years of age or older. I authorize San Manuel Entertainment Authority, an unincorporated instrumentality of the San Manuel Band of Mission Indians ("SMEA"), and its agent, National Cred-A-Check, Inc. and its affiliates ("NCC") to obtain consumer reports, to contact financial institutions, and to check my consumer credit, employment, business affiliation(s), bank balances, gaming history and make related inquiries in order to evaluate my credit application. I further authorize SMEA and NCC to conduct all investigations necessary to verify such information through any source and to report any information to another casino (excluding consumer report data obtained from a consumer reporting agency) and to exchange any information with any affiliates of SMEA. I also authorize SMEA and NCC to update and/or review my credit account to provide services requested by me, as necessary or as required by law.
I hereby release and waive, and agree not to bring at any time in the future, any claims or demands against SMEA or its agents and representatives relating to any credit investigation made pursuant to my authorization and instructions here, including, without limitation, the collection, processing and transmission of my information and data.
Per SMEA policy and procedures, a completed and signed application is required prior to the extension of credit. If through investigation it is discovered that information contained in this application is inaccurate or was falsely provided, civil and criminal actions may be taken, and if credit has been extended, an immediate demand for payment may be made.
If collection is required, I agree and consent to exclusive personal jurisdiction of the appropriate federal or state courts in or for the County of San Bernardino, State of California, to hear and determine any claims or disputes pertaining directly or indirectly to this Application, provided that nothing herein shall constitute a waiver of the sovereign immunity of SMEA or San Manuel Band of Mission Indians. I also agree to pay all costs of collections, including SMEA attorney fees and court costs, in addition to any amounts authorized by law. If I have not paid my debt in a timely manner, as agreed, I authorize SMEA to retain all jackpots, chips or winnings and to apply the same toward the reduction of any outstanding credit balance with the remainder, if any, being returned to me.
