Under Nevada law, a casino credit instrument, sometimes referred to as a marker or casino check, is considered a personal check and may be deposited in or presented for payment to a bank or other financial institution, as may any personal check provided in payment of credit extended by a casino.
NOTICE IS HEREBY GIVEN THAT THE ISSUANCE OF A CHECK OR DRAFT WITHOUT SUFFICIENT MONEY OR WITH INTENT TO DEFRAUD IS PUNISHABLE BY IMPRISONMENT IN THE COUNTY JAIL FOR NOT MORE THAN 6 MONTHS, OR BY A FINE OF NOT MORE THAN $1,000, OR BY BOTH FINE AND IMPRISONMENT, AND THE ISSUANCE OF SUCH A CHECK OR DRAFT IN AN AMOUNT OF $1,200 OR MORE OR BY A PERSON WHO PREVIOUSLY HAS BEEN CONVICTED THREE TIMES OF THIS OR A SIMILAR OFFENSE IS PUNISHABLE AS A CATEGORY D FELONY AS PROVIDED IN SECTION 193.130 OF THE NEVADA REVISED STATUTES. I hereby request that MGNV, LLC at Virgin Hotels Las Vegas (hereinafter referred to as "MGNV, LLC") grant me credit. In furtherance of this request I hereby authorize MGNV, LLC and its representatives to obtain and verify my financial information (including but not limited to account balance information) from any source, to obtain my financial and employment history, and to exchange information with others about my financial and account experience, excluding credit agencies for which exchanges of such information are prohibited by law or by those agencies’ policies. I agree not to hold any entity or individual responsible or liable for any information released, nor MGNV, LLC for its use of any such information. I agree that MGNV, LLC may retain and use the information on this application for credit, as well as any information it receives based on the foregoing authorization, whether or not I am granted credit. As a condition to being granted credit, I agree to sign casino credit instruments, markers or checks in the form presented to me by MGNV, LLC in the amount of the funds or other representatives of value (including without limitation chips, credits or vouchers) issued to me.
I authorize MGNV, LLC to complete any of the following information on a casino credit instrument, marker or check executed by me: 1) name of payee, 2) any missing amounts, 3) a date, 4) name, account number, and/or address of any of my banks and financial institutions, 5) electronic encoding of the above, and 6) any other information not prohibited by law. The information inserted may be for any account from which I now or may in the future have the right to withdraw funds, regardless of whether that account now exists or whether I provided the information on the account to MGNV, LLC. I represent that at the time I sign any casino credit instrument, marker or check I have on deposit in accounts on which I am authorized signatory for all purposes, without restriction, funds sufficient to pay such casino credit instrument, marker or check upon demand.
I acknowledge that irrespective of any currency exchange laws in the country in which I reside, I have the ability and intent to legally pay through my bank or financial institution the funds represented by the casino credit instruments, markers or checks signed by me and given to MGNV, LLC.
I agree that Nevada law exclusively applies to these credit transactions, that the exclusive jurisdiction for any dispute arising out of or related to any of the above shall be a state or federal court sitting in Clark County, Nevada, and that I waive any requirement of presentment.
In addition to any amounts authorized the law, I will pay interest at the rate of the lesser of eighteen percent (18%) per annum, or the highest amount permitted by Nevada law, from the date of issuance of the casino credit instrument, marker or check (if dishonored by a financial institution), plus all costs of collection, including attorney’s fees and court costs. I agree that the information set forth above is true and accurate to the best of my knowledge.
I hereby authorize and instruct MGNV, LLC and its agent NRT Technologies, Inc. and VisuaLimits, LLC, ("NRT.") and their affiliates to obtain consumer reports, to contact financial institutions, and to check my consumer credit, employment, bank and gaming history in order to evaluate my credit application, as well as to update and/or review my account to provide services requested by me, as deemed necessary in the sole discretion of MGNV, LLC or as required by law. I further authorize MGNV, LLC, NRT or their affiliates to verify such information through any source and to report any information to another casino, excluding credit report data obtained from a credit agency, and to exchange any information with any affiliates of MGNV, LLC. I hereby release and waive, and agree not to bring at any time in the future, any claims or demands against MGNV, LLC, NRT or any of their affiliates relating to any credit investigation, including without limitation the collection, processing, and transmission of my information and data, made pursuant to the foregoing authorization and instructions.
