I hereby authorize Tropicana Las Vegas Inc. to conduct such investigation pertaining to the above information as it deems necessary for the approval of my credit limit, including an investigation of my personal credit report, and to furnish information concerning my credit records and my credit and account experience with Tropicana Las Vegas Inc. to credit reporting agencies and others who may properly receive this information. I certify that I have reviewed all of the information provided above, that it is true and accurate, and that I am 21 years of age or older. I acknowledge that this application is required by the Nevada State Gaming Control Board, and that I may be subject to civil or criminal liability if any material information provided by me is willfully false. Before drawing on my line of credit, if granted, I agree to sign credit instruments (i.e., checks) in the amount of the draw. I hereby authorize Tropicana Las Vegas Inc. to complete any of the following missing items on these credit instruments: (1) the name of the payee, (2) any missing amounts, (3) a date, (4) the name, account number, and/or address and branch of my bank or financial institution, and (5) any electronic encoding of foregoing items. This information can be for any account which I may in the future have the right to draw funds upon, whether that account now exists or whether I provided the information about that account to the payee. I agree that each draw against my credit line is a separate advance of money by Tropicana Las Vegas Inc. If I receive an advance before I execute a credit instrument, I will sign promptly a credit instrument in the amount of the advance. I hereby authorize Tropicana Las Vegas Inc. to first apply any and all chips, tokens, or other instrumentalities I may redeem to the reduction of any outstanding credit balance, with the remainder, if any, to be returned to me. The credit issued by Tropicana Las Vegas Inc. is to be used solely for the purpose of gaming at Tropicana Las Vegas Inc., and Tropicana Las Vegas Inc. reserves the right to refuse to cash out chips, tokens or other instrumentalities not used for gaming. I agree that this application, all credit issued to me, and all credit instruments signed by me will be governed and interpreted solely pursuant to the laws of the State of Nevada. In addition to any amounts authorized by law, I will pay interest at the rate of 18% per annum (or the maximum percentage allowed by law if different than the rate stated herein) from the date of issuance on any unpaid credit or credit instruments, plus all costs of collection, including attorney's fees and court costs. I agree that Tropicana Las Vegas Inc. may litigate any dispute involving my credit line or any credit or credit instruments issued thereunder in any court, state or federal, in Nevada. I hereby submit to the jurisdiction of any court, state or federal, in Nevada. I further represent that I have not been excluded from any gaming operation, nor have any of my privileges at any gaming operation been restricted, either voluntary or by action of law.
WARNING: FOR THE PURPOSES OF NEVADA LAW, A CREDIT INSTRUMENT IS IDENTICAL TO A PERSONAL CHECK AND MAY BE DEPOSITED IN OR PRESENTED TO A BANK OF OTHER FINANCIAL INSTITUTION ON WHICH THE CREDIT INSTRUMENT IS DRAWN. WILLFULLY DRAWINGOR PASSING A CREDIT INSTRUMENT WITH THE INTENT TO DEFRAUD, INCLUDING KNOWING THAT THERE ARE INSUFFICIENT FUNDS IN AN ACCOUNT UPON WHICH IT MAY BE DRAWN, IS A CRIME IN THE STATE OF NEVADA, WHICH MY RESULT IN CRIMINAL PROSECUTION IN ADDITION TO CIVIL PROCEEDINGS TO COLLECT THE OUTSTANDING DEBT.
