I understand that persons under the age of 21 are not permitted to gamble in the Commonwealth of Virginia. I acknowledge that I must be 21 years of age or older to apply for a credit line with Golden Eagle Consulting II, LLC ( herein after "The Interim Gambling Hall" or "IGH"). Accordingly, I certify that I am 21 years of age or older. I further represent that I have not been excluded from any gaming operation, nor have any of my privileges at any gaming operations been restricted, either voluntarily or by action of law.
I give IGH and its representatives authorization to obtain and verify my information, or, if applicable, my sole-proprietor’s information from any source and to exchange such information with others. I understand and acknowledge that my information includes, but is not limited to, information about account balances, account opening dates, and account average balances. I agree not to hold any entity responsible or liable for the information released, and further agree not to hold IGH responsible or liable for its use of any such information. I agree that IGH may, but is not obligated to, retain and use the information in this credit application and any information it receives based on my authorization whether or not I am granted credit. The information provided herein is subject to the Privacy Policy of IGH, which is available at the Privacy Policy.
If I am granted any credit, I agree to promptly sign negotiable credit instruments (a "Counter Check" or multiple "Counter Checks"), without delay or condition, in the amount of the funds (e.g., chips, credits, tokens, electronic credits, electronic cash, electronic cards, etc.) issued to me. I further authorize IGH to complete or correct any of the following information on any of my Counter Checks: (1) name of payee, (2) amounts, (3) a date, (4) name, account number or address of any of my banks and financial institutions, (5) electronic encoding of the above, and (6) any other information authorized by law. The information inserted or corrected may be for any account in which I now have, or may in the future obtain, the right to withdraw funds, regardless of whether that account now exists, and whether I provided the information on the account to IGH. I hereby waive any right to place a stop payment on any Counter Check and further waive any right for presentment of payment. The terms stated in this credit application apply to any personal or business check issued to IGH for the payment of any casino debt.
In accordance with this credit application, I represent that at the time any funds (e.g., chips, credits, tokens, electronic credits, electronic cash, electronic cards, or similar instruments) are issued to me, whether or not I signed a Counter Check, I have sufficient, unrestricted funds on deposit in accounts for which I am an authorized signatory to cover the full amount issued to me upon demand or presentment. If I receive the funds before I execute a Counter Check, I will promptly sign a Counter Check issued to me, without delay or condition, in the amount of the funds I received. I agree that each Counter Check issued to me for my signature is a separate transaction. I hereby authorize IGH, in its sole discretion, to apply any and all chips, credits, tokens, electronic credits, electronic cash, electronic cards, or similar instruments that I may redeem, first to the reduction of any outstanding credit balance, with the remainder, if any, to be returned to me.
I acknowledge that irrespective of any gambling, debt collection, or currency exchange laws in the country in which I reside, I have the ability and intent to legally pay through my bank or financial institution the funds represented by the Counter Check issued to me, and I hereby waive any such laws that may otherwise prohibit or limit my obligations as provided herein. If any such waiver is deemed unlawful, I agree that my waiver is to be enforced to the fullest extent permitted by applicable law.
I agree that any credit granted to me may be suspended or revoked at any time and without notice to me by IGH. I hereby release IGH, including its officers, employees and agents, from any and all claims, damages or losses that I may incur as a result of such credit being suspended or revoked.
Any actions, proceedings, or litigation arising from my debt, IGH granting or denying me credit, or information contained in this credit application, are governed by and construed in accordance with the laws of the Commonwealth of Virginia, without giving effect to its conflict of law provisions. I KNOWINGLY AND INTENTIONALLY WAIVE THE RIGHT TO A JURY TRIAL FOR ANY ACTION OR DISPUTE BETWEEN ME AND IGH ARISING FROM THIS CREDIT APPLICATION, MY DEBT, OR IGH’S GRANTING OR DENIAL OF CREDIT.
I consent to the jurisdiction of any state or federal court in the Commonwealth of Virginia, as well as any court in the jurisdiction where I reside, and waive all objections or defenses thereto. I waive any right to bring any action, proceeding, or litigation arising from my debt, this credit application, or IGH's granting or denial of credit outside of the Commonwealth of Virginia. Without limiting in any way the preceding consent or waivers, in the event IGH or its agents commence an action, proceeding, or litigation against me in another jurisdiction in which I may reside or hold assets, then the parties have waived their respective rights with respect to the venue provisions contained herein.
I acknowledge that willfully drawing or passing a credit instrument with the intent to defraud, including doing so with knowledge of insufficient funds in my account, is a criminal offense in the Commonwealth of Virginia and may result in my prosecution. I further understand that providing false or misleading statements, or omitting material information on this credit application, may subject me to civil or criminal penalties.
I further agree that if I do not pay any Counter Checks in full when due, that I will pay interest on all such Counter Checks at the rate of 18% per annum until paid in full, plus related costs and attorneys’ fees incurred by IGH. I understand that a Counter Check is identical to a personal check under Virginia law, and a Counter Check may be deposited in or presented for payment to a bank or other financial institution on which such Counter Check is drawn.
I certify that I have reviewed all the information provided with this credit application and I verify the information is true and accurate to the best of my knowledge.
