I authorize RWLV and/or its agent to conduct investigations (whether present or ongoing) relating to the information provided in this credit application for the approval of my credit line (including any future updates) or as otherwise required by applicable law. I understand such investigation may include, but is not limited to, contacting financial institutions where I have a bank account, obtaining my credit history, and verifying the information provided in this credit application through any source. I agree that RWLV may retain or use the information in this credit application based on my authorization and any other information it receives, whether or not I am granted a credit line. I agree that upon request by RWLV, I will provide updated personal and financial information.
I acknowledge that the information provided in this credit application will be subject to RWLV's Privacy Policy located at https://www.rwlasvegas.com/privacy-policy and agree to be bound by the terms and conditions therein. I consent to the exchange and sharing of information provided in this credit application, including related financial or account information, with RWLV’s affiliates or third-party service providers. I understand that RWLV may disclose information about me to any government agencies as required by applicable law. I agree not to hold RWLV or its affiliates liable for any action taken as a result of any credit investigation made pursuant to my authorization herein or for the information released.
Before drawing on my credit line, if granted, I agree to sign credit instruments (e.g. a "marker") in the amount of the funds issued to me, whether in the form of chips, cash, or other types of gaming instruments. I further agree that each marker I sign is a separate transaction. If I receive funds drawn on my credit line before I execute a marker, I will promptly sign a marker when presented to me, in the amount of the funds I received. I agree that any marker issued to me will be used only for gaming.
I authorize RWLV to complete any of the following information on any marker issued to me: (1) name of payee; (2) date; (3) name, account number, and/or address of any of my banks or financial institutions; (4) electronic encoding of the above; (5) any missing amount; and (6) as otherwise authorized by applicable law. The information inserted may be for any account from which I now or may in the future have the right to withdraw funds, regardless of whether that account now exists or whether I provide information on such account to RWLV. I REPRESENT THAT AT THE TIME I SIGN ANY MARKER, I HAVE ON DEPOSIT IN ACCOUNTS ON WHICH I AM AN AUTHORIZED SIGNATORY FOR ANY PURPOSE, THE FUNDS SUFFICIENT TO PAY SUCH MARKERS UPON DEMAND. I hereby authorize RWLV in its sole discretion, to apply any and all chips, slots winnings, or other cash or cash equivalents that I may redeem, first to the reduction of any outstanding credit balance, with the remainder, if any, to be returned to me. I further authorize RWLV to deposit any marker as set forth in this credit application.
I acknowledge that irrespective of any currency exchange laws in the country in which I reside, I have the ability and intent to legally pay any funds represented by the marker signed by me. I also acknowledge that an independent agent collecting front money deposits or payments on my outstanding credit balance is my agent and not an agent for RWLV or any of its affiliates.
I acknowledge and agree that any credit instrument drawn on my credit line evidences a gaming debt owed to RWLV pursuant to Nevada Revised Statutes 463.01467. I agree that any dispute involving the terms and conditions of this credit application, including all credits or advances issued pursuant thereto, shall be governed, construed, and enforced exclusively pursuant to the laws of the State of Nevada. I agree to submit to the exclusive jurisdiction of any court, state or federal, in the State of Nevada. In the event of a collection action, I agree to pay all costs associated with such collection, including accrued interest at a rate of eighteen and one-half percent 18 ½ % per annum from the date the credit instrument was executed, plus attorneys' fees and court costs incurred by RWLV. I further represent that I have not been excluded from any gaming operation, nor have had any of my privileges restricted at any gaming operations, either voluntarily or by action of law.
Warning: for the purposes of Nevada law, a credit instrument is identical to a personal check and may be deposited in or presented for payment to a bank or other financial institution on which the credit instrument is drawn. Willfully drawing or passing a credit instrument with the intent to defraud, including knowing that there are insufficient funds in an account upon which it may be drawn, is a crime in the State of Nevada which may result in criminal prosecution in addition to civil proceedings to collect the outstanding debt.
I hereby represent and warrant the following: I am 21 years of age or older, I am the person for whom credit is requested, I have reviewed all of the information provided in this credit application, the information I have provided (or may provide in the future) to RWLV is (and will be) true and accurate to the best of my knowledge, and that I agree to be bound by all of the terms and conditions set forth herein.
