I certify that I have reviewed all my personal information I have provided for this application and that it is true and accurate. I further certify that I have read and understand the terms and conditions set forth in this credit application and I execute this agreement voluntarily and with full knowledge of its significance. I authorize Resorts World, and its attorneys or agents to conduct such investigation pertaining to the information I have provided, as well as my finances and credit, as it deems necessary for the approval of my credit limit (which includes my use of front money) and the collection of any outstanding amounts owed. I am aware that I may be subject to civil or criminal liability if material information provided by me is willfully false or if I fail to pay amounts provided to me by Resorts World, when due. I authorize Resorts World and their attorneys and agents to conduct a consumer investigation into my credit worthiness and to provide such information to the credit reporting agencies and other persons who are permitted to receive such information. I am 18 years of age or older, I hereby authorize Resorts World, in its sole discretion, to apply any and all chips I may redeem to the reduction of any outstanding credit balance, with the remainder, if any, to be returned to me.
I further understand and agree that in the event it becomes necessary for Resorts World to institute collection actions with respect to any credit granted, I agree and consent to exclusive jurisdiction of the State Courts of New York, located in Sullivan County, New York, as a convenient forum for venue and jurisdiction. I agree that any and all of my dealings with Resorts World, including, but not limited to the enforcement of this application, and the collection of any money which I owe to Resorts World, shall be governed, construed and enforced in accordance with the laws of the State of New York, without regards to New York law on conflicts of law. I agree to be responsible for all costs and expenses associated with the collection of any money which I owe to Resorts World, including reasonable attorney fees and I will be responsible for payment of interest at the simple interest rate of 12% per year on the credit from the date that I defaulted on the payment. I understand and agree that attorney fees may be calculated as a percentage of all amounts owed to Resorts World, including interest and costs, and I agree to be responsible for such
JURY WAIVER - THE PARTIES ACKNOWLEDGE THAT THEY MAY HAVE A RIGHT TO SEEK A TRIAL BY JURY OF DISPUTES ARISING HEREUNDER. NOTWITHSTANDING SUCH RIGHT, EACH PARTY HEREBY (A) KNOWINGLY AND VOLUNTARILY AGREES TO, AND DOES, WAIVE AND RELINQUISH SUCH RIGHT TO THE FULLEST EXTENT PERMITTED BY NEW YORK LAW AND (B) SPECIFICALLY AGREES THAT THEY SHALL NOT SEEK A TRIAL BY JURY OF ANY ISSUE OR WITH REGARD TO ANY DISPUTE ARISING UNDER THIS APPLICATION AND AGREEMENT. THIS WAIVER OF TRIAL BY JURY IS INTENDED TO ENCOMPASS INDIVIDUALLY EACH INSTANCE AND EACH ISSUE AS TO WHICH THE RIGHT TO TRIAL BY JURY MAY OTHERWISE ACCRUE OR EXIST.
I authorize Resorts World to use information from my previously verified bank account to make an electronic fund transfer (ETF) or automated clearing House (ACH) debit, bank draft, or process as a check transaction. I understand and agree that Resorts World may complete any missing information such as amount, account number, date, bank destination or any electronic coding.
