I authorize Ocean Casino Resort to conduct a consumer investigation pertaining to the information provided by me and referenced above if Ocean Casino Resort deems an investigation necessary for the approval of my credit and credit limit. I authorize Ocean Casino Resort to provide my information to the credit reporting agencies and other persons who are permitted to receive such information while Ocean Casino Resort is conducting their consumer investigation into my credit worthiness. I am aware the laws and regulations of the State of New Jersey require this application to be prepared and that I may be subject to civil or criminal liability if material information provided by me is willfully false. I understand Ocean Casino Resort reserves the right to deposit outstanding markers immediately based on the credit agreement signed below. I further understand and agree that in the event it becomes necessary for Ocean Casino Resort to institute collection actions with respect to credit granted to me by Ocean Casino Resort, I agree the laws of the State of New Jersey shall apply to my credit application, all credit issued, and all collection actions. I agree and consent to the jurisdiction of the New Jersey Superior Court located in Atlantic City, New Jersey for all legal or administrative matters, and I further waive any right to a jury trial. I will be responsible for all costs and expenses associated with any collection efforts, including reasonable attorney fees, and I will be responsible for payment of interest on the credit issued to me from the date that I defaulted on the payment and the interest shall be calculated at the greater of either an interest rate of 25% per annum or according to the rules on pre-judgment and post-judgement interest as set forth in the State of New Jersey Court Rules. I hereby authorize Ocean Casino Resort, in its sole discretion, to apply any and all chips, cash and cash equivalents that I am entitled to redeem to the reduce any outstanding credit balance, with the remainder, if any, to be returned to me. I authorize Ocean Casino Resort to use information from my previously verified bank account to make an electronic fund transfer (EFT) or automated clearing house (ACH) debit, bank draft, or process as a check transaction. I understand and agree that Ocean Casino Resort may complete any missing information on any account I have with Ocean Casino Resort, including but not limited to missing information such as payee, amount, account number, date, bank destination or any electronic coding. I affirm that I am authorized to enter into this agreement and to draw against the above accounts without notice. The above are current and continuing representations which I intend Ocean Casino Resort to rely upon currently and moving forward and shall be deemed made by me each and every time I request credit or sign and deliver checks or markers to Ocean Casino Resort.
