By submitting Little River Casino Resorts online application (Application), I give Little River Casino and its officers, employees, agents and representatives authorization to obtain and verify my financial information periodically from any source and to exchange such information with others about my financial account experience with Little River Casino Resort. I agree not to hold any person or entity responsible or liable for its use of any such information I provided on or in conjunction with any credit application and any information it receives based on my authorization, including but not limited to any information with regards to source of funds, whether or not I am granted credit. I further authorize Little River Casino Resort to obtain any records from my banks and financial institutions. I agree that any credit granted to me may be suspended or revoked at any time and without notice by Little River Casino Resort and I hereby release Little River Casino Resort including it officers, employees, representatives and agents, from any and all claims, damages, or losses that I may incur as a result of such credit being suspended or revoked.
I represent and warrant that I am applying for credit from Little River Casino Resort for my own personal gaming purposes and that any credit extended to me by Little River Casino Resort will be used only by me and only for that purpose. I agree that I am liable for the repayment of any and all credit that is extended to me by Little River Casino Resort regardless of how or by whom such credit is used. I hereby irrevocably and unconditionally waive any claim or defense that I am not liable for the repayment of any portion of the credit that is extended to me for any reason, including, but not limited to, the allegation that such credit was used by, or for the benefit of another person, with or without the knowledge or consent of Little River Casino Resort.
With respect to the collection of my account(s): (1) I agree to submit to the jurisdiction of the Little River Band of Ottawa Indians Tribal Court and (2) I agree to pay all costs of collection, including investigator and attorney fees and court costs, in addition to any amounts authorized by law. I hereby authorize Little River Casino Resort to retain and apply any and all jackpots, chips, or winnings first to the reduction of any outstanding credit balance with the remainder, if any, returned or paid to me as appropriate. I hereby consent to the domestication in any country or jurisdiction in which I have ever resided or in which I have ever owned property any judgement that is entered against me in connection with any bad negotiable instrument that I give to Little River Casino Resort, and I hereby irrevocably and unconditionally waive any and all defenses to such domestication, procedural and substantive, that I might otherwise have. I agree that such judgment may be enforced against me or my property in any such country or jurisdiction in the same manner, and to the same extent, as a judgment that is rendered by a court in such country or jurisdiction.
I acknowledge that I am 18 years of age or older. I authorize Little River Casino Resort to complete any of the following missing items on any Marker or similar credit or payment instruments: (1) name of payee; (2) any missing amounts; (3) date; (4) name, account number, and/or address and branch of any banks and financial institutions; and (5) any electronic encoding of the above items. This information can be for an account I own and from which I now or at some point in the future have a right to withdraw funds from without someone else’s approval, regardless of whether that account now exists or whether I provided the information on the account to Little River Casino Resort.
I certify that all of the information provided on this Application is true and accurate. I further understand that willfully drawing or passing a credit instrument and subsequent failure to pay such credit instrument with the intent to defraud, including knowing that there are insufficient funds in an account upon which it may be drawn, is a crime under Tribal and other law and may result in criminal prosecution in addition to civil proceedings to collect the outstanding debt. Finally I consent to the jurisdiction of the laws and courts of the Little River Band of Ottawa Indians. Nothing contained in the terms and conditions of the Little River Casino Resort is intended to serve as an express or implied waiver of sovereign immunity by the Little River Band of Ottawa Indians.
