Consent to Extension of Credit Terms and Conditions

By signing below, I acknowledge and agree that:

This is an application for credit only and the Casino has no obligation to accept and approve my application or advance any funds to me until the Casino approves my application. I acknowledge that the Casino may approve me for a lower credit limit than the limit I requested. Once approved, I will be bound by the terms and conditions of the Agreement.

I have read and understood the Agreement, including the information set out in the Terms and Conditions and the Key Financial Terms above, and agree to be bound by its terms.

All of the information provided in and in connection with this Casino Credit Application is true, accurate and complete.

Any credit granted to me by the Casino is intended for my personal gaming use only and is not being requested on behalf of, nor will it be used by a third party. I am liable for repayment of any and all credit that is extended to me by the Casino regardless of how or by whom such credit is used. I irrevocably and unconditionally waive any claim or defense that I am not liable for the repayment of any portion of the credit that is extended to me for any reason, including, but not limited to, the allegation that such credit was used by, or for the benefit of another person, with or without the knowledge or consent of the Casino.

I acknowledge receipt of Hard Rock Ottawa, L.P.’s Privacy Policy. Notice of Collection, Use and Disclosure: Personal Information may be collected directly or from third parties, used and disclosed by HR Ottawa, L.P. and OLG pursuant to the Ontario Lottery and Gaming Corporation Act for the purpose of assessing credit applications, providing credit services, and compliance with applicable laws. I consent to the Casino obtaining a credit bureau report in connection with this Casino Credit Application from a credit reporting agency for the purpose of assessing my application. The credit bureau report may include information on the types and amounts of credit advanced to me, payment histories, negative banking items, collection actions, legal proceedings, previous bankruptcies and other information reported by my creditors. If I am approved and the Casino and I enter into the Agreement, I also consent to the Casino obtaining a credit bureau report from time to time for the purposes of assessing my ongoing creditworthiness and as further described above. The Casino will provide me with the name and address of the credit reporting agency on request. My consent to obtain a credit bureau report will remain valid for the time period required to process the Casino Credit Application and for the duration of any Agreement which may result.

Initial Credit Limit

My Initial Credit Limit will be set out in my welcome letter.

Annual Interest Rate

0%

Advances

I may only request an advance in person at the Casino. The total amount of outstanding advances cannot be more than my credit limit, unless I am approved for a temporary trip increase. See Section 2 of the Casino Credit Terms and Conditions for details.

Minimum Payment

The full amount of each advance is due: 14 days after the advance date if the advance is $10,000 or less; or 30 days after the advance date if the advance is more than $10,000. Any and all chips or tickets I may redeem at the Casino will be applied to any outstanding amounts.

Term

This Agreement will remain in effect until I or the Casino terminate it as set out in the Terms and Conditions.

Security

Each time I request an advance, I must provide a marker to the Casino for the full amount of the advance. The Casino will cash the marker on the Minimum Payment due date unless I have made other payment arrangements.

Signature

I, the undersigned, hereby authorize and instruct Hard Rock Hotel & Casino Ottawa and its agent NRT Technologies, Inc. and VisuaLimits, LLC. ("NRT") and its affiliates to obtain consumer reports, to contact financial institutions, and to check my consumer credit, employment, bank and gaming history in order to evaluate my credit application as well as to update and/or review my account to provide services requested by me, as necessary or as required by law. I authorize Hard Rock Hotel & Casino Ottawa, NRT or its affiliates to verify such information through any source and to report any information to another casino, excluding credit report data obtained from a credit agency, and to exchange any information with any of the affiliates of the Company. I hereby release and waive, and agree not to bring at any time in the future, any claims or demands against NRT or its affiliates relating to any credit investigation made pursuant to my authorization and instructions herein, including, without limitation, the collection, processing, and transmission of my information and data.
