Privacy Statement: In the course of providing services hereunder, Golden Nugget Lake Charles, LLC and/or its affiliate companies (collectively "Golden Nugget") obtain certain and personal information about its customers or former customers that may be considered confidential. Golden Nugget does not disclose any of this information about its customers or former customers to anyone, except among affiliate companies, as required by law or as otherwise described below. Golden Nugget’s Privacy Statement is subject to change and its customers will be informed of any changes to the policy as required by law. By signing below, you give Golden Nugget and its representatives, vendors, and agents permission to obtain and verify credit and financial information from any source (including but not limited to account balance information), obtain your credit and employment history and exchange information with others about your credit history and account experience with Golden Nugget. You agree not to hold Golden Nugget or any of these entities responsible or liable for the information released and waive any potential claims regarding the same. You agree that Golden Nugget has the right to retain this application whether or not Golden Nugget approves the transaction.
Agreement: If this transaction is approved by Golden Nugget, I agree to sign this agreement below and any applicable financial instruments such as checks or markers drawn on my bank, in the amount of the funds, whether in the form of cash or gaming chips, issued to me ("Applicable Instrument(s)"). I agree that each draw against such Applicable Instrument(s) is a separate advance of money by Golden Nugget. If I receive the advance before I execute the Applicable Instrument(s), I will promptly sign the Applicable Instrument(s) in the amount of the advance. I authorize Golden Nugget to complete any of the following missing items on these Applicable Instrument(s): (1) the name of a payee, (2) any missing amounts, (3) a date, (4) the name, account number, and/or address and branch of any banks and financial institutions, (5) electronic encoding of the above items, and (6) as otherwise authorized by law. This information can be for any account from which I now have or may in the future have the right to withdraw funds, regardless of whether that account now exists or whether I provided the information on the account to Golden Nugget. I REPRESENT THAT AT THE TIME I SIGN ANY APPLICABLE INSTRUMENT(S), I HAVE ON DEPOSIT IN THE ACCOUNT(S) INDICATED THEREON, ON WHICH I AM AN AUTHORIZED SIGNATORY FOR ALL PURPOSES, WITHOUT RESTRICTION, FUNDS SUFFICIENT TO PAY SUCH APPLICABLE INSTRUMENT(S) UPON DEMAND OR PRESENTMENT BY GOLDEN NUGGET. I further agree to pay on demand all sums due as a result of any amount(s) advanced by Golden Nugget, irrespective of the validity of, or sufficiency of funds in, the account indicated on the Applicable Instrument(s). I waive any right, statutory or otherwise to stop payment on any Applicable Instrument(s) issued in connection with the monetary advances made to me by Golden Nugget.
I acknowledge and agree that: (A) under Louisiana Revised Statute Title 10 Section 3-104(f) a "marker" is identical to a check; (B) Applicable Instrument(s), including "markers," will be deposited or presented for payment by Golden Nugget to a bank or other financial institution in the normal course of business (which will be no longer than 45 days from the date of my issuance); and (C) returned checks may subject me to civil and/or criminal action as allowed by applicable law.
I acknowledge that irrespective of any currency exchange laws in the country in which I reside, I have the ability and intent to legally repay through my bank or financial institution any advance of money by Golden Nugget. I also acknowledge that an independent agent collecting front money deposits or payments on my debt is my agent and not an agent for Golden Nugget.
I agree that Louisiana law exclusively governs the terms of all transaction conducted with Golden Nugget. I agree that the Golden Nugget may litigate any dispute involving the Applicable Instrument(s) or the payee in any court, state or federal, in Calcasieu Parish, Louisiana. I submit to the jurisdiction of any court, state or federal, in Calcasieu Parish, Louisiana. I further waive any requirement of presentment and waive any objections to lack of personal jurisdiction or improper venue in such courts. I further agree that service of process may be made by Golden Nugget on me by certified mail, return receipt requested, at the address above and waive any defense as to lack of personal service.
If any Applicable Instrument is dishonored by a financial institution when presented for payment by Golden Nugget, I will pay interest at a rate equal to the lesser of 18% per annum or the maximum interest permitted under applicable law from the date of issuance of the markers and all costs of collection, including attorneys’ fees and court costs. I represent, warrant and agree that the information set forth above is true and accurate to the best of my knowledge. I am aware that this application is required to be prepared in accordance with the regulations of the Louisiana Gaming Control Board and I may be subject to civil or criminal liability if any material information provided by me is false. I also certify that I am 21 years of age or older. I understand that Louisiana law prohibits persons under the age of 21 from engaging in gaming activity. Accordingly, I must be 21 years of age or older to apply for and obtain a marker line/check cashing at Golden Nugget.
I authorize Golden Nugget, in its sole discretion, to apply all chips, plaques, slot tokens or slot tickets that I may redeem, first to the reduction of my outstanding Applicable instrument balance with the remainder, if any, to be returned to me in cash. I agree that any partial payment on account of outstanding debt owed to Golden Nugget shall be deemed an acknowledgement by me of the total remaining outstanding balance and will not be construed as an accord and satisfaction of the total outstanding debt owing.
I HEREBY ACKNOWLEDGE AND AGREE THAT (A) GOLDEN NUGGET HAS THE RIGHT TO PRESENT ANY APPLICABLE INSTRUMENT(S) FOR PAYMENT TO FINANCIAL INSTITUTION AT ANY TIME FOLLOWING MY EXECUTION; AND (B) ANY HOLDING PERIOD OF WHICH I AM MADE AWARE BY GOLDEN NUGGET IS PROVIDED SOLELY AS AN ACCOMMODATION AND THAT GOLDEN NUGGET HAS THE RIGHT, IN ITS SOLE DISCRETION, TO RESCIND THE HOLDING PERIOD AT ANY TIME WITHOUT NOTICE.
