I hereby certify that the information provided in this Credit Application (“Application”) is true and complete. I authorize Bowtie Hospitality LV LLC dba Fontainebleau Las Vegas, its affiliates and their representatives (collectively, “Fontainebleau”) at various times as it deems reasonable to verify such information through any source, to execute any and all actions disclosed in the Authorization to obtain Credit Report provisions of the Casino Credit Acknowledgment, which is incorporated in full here, to obtain any credit-related, gaming-related, business-related or employment history information about me (“Information”), and to report any Information to another casino or to a credit reporting agency, as well as to government agencies as required by applicable law. I agree not to hold any of these persons or entities responsible or liable for the Information released. I agree that Fontainebleau will retain this application whether or not it approves my Application.
Before drawing on any line of credit, I agree to sign instruments (i.e. markers or checks) in the amount of the draws. I authorize Fontainebleau to complete any of the missing items on any instrument including: (a) the name of the payee; (b) any missing amount; (c) date; (d) name, account number, or address and branch of any bank or financial institution; and (e) any electronic coding. The information provided in items (d) and (e) above may be for any account from which I now have or may later have the right to withdraw funds. Fontainebleau may obtain payment of any instrument from any existing or future bank account regardless whether I provided the information about the account to Fontainebleau. Casino credit is intended to be used solely for gaming purposes. Each draw against my credit line constitutes a separate transaction. If I receive any funds before I execute an instrument, I will promptly sign an instrument in the amount of the funds received. Fontainebleau, in its sole discretion, may apply all chips I seek to redeem, first to the payment of any amount owed Fontainebleau, with the remainder, if any, returned to me. I agree to waive any requirements of presentment. I understand that while Fontainebleau may elect to hold any instrument before depositing or seeking payment, I hereby agree that each instrument I execute is unconditional and is payable upon demand. By signing any instrument, I represent that I have on deposit in accounts on which I am an authorized signatory, without restrictions, funds sufficient to pay such instrument upon demand.
I agree that the terms and conditions of this Application are governed exclusively by the laws of the State of Nevada. I hereby agree that Nevada law exclusively governs the determination of any claim, regardless of any choice of law, statutes, rules, in any jurisdiction where an action may be brought, relating to or arising from this instrument, my credit line or my gaming activities in Nevada and hereby submit to the jurisdiction of any competent Court in Clark County, Nevada, or any jurisdiction where my assets are located, at the sole discretion of Fontainebleau. If I fail to pay the outstanding balance of my credit line, I agree that in addition to any amounts authorized by law, I shall be liable for interest at the rate of 18% per annum from the date of execution of any instrument, plus all costs of collection, including, but not limited to, reasonable attorneys’ fees. All payments are to be made in U.S. funds only. I also acknowledge that an independent agent collecting front money deposits or payments on any debt is my agent and not an agent for Fontainebleau.
I, hereby intentionally and voluntarily waive, to the fullest extent permitted by applicable law, any right which I may have to a trial by jury in any legal proceeding directly or indirectly arising out of or relating in any way to the credit line, any debt or any instruments drawn on my credit line whether based on contract, tort or any other theory.

No violation of this Application or any regulation by Fontainebleau shall constitute: (a) a defense in any action by Fontainebleau or a person acting on behalf of Fontainebleau to enforce an instrument or the debt that the instrument represents; or (b) a basis for a valid counterclaim to such an action or a claim in any action. Further, this Application is not an “other agreement” within the meaning of NRS 104.3117 that would modify, supplement, or nullify any instrument.
I certify that all banking information provided pertains to my personal accounts. I acknowledge receipt of a copy of the Privacy Notice of Fontainebleau and a copy of the Casino Credit Acknowledgment. I also understand and agree that I may exercise my rights to opt out of sharing personal information at any time in the future by notifying Fontainebleau as set forth in the Privacy Notice.
