At Celebrity Cruises Fortunes Casino (hereinafter the "Casino"), we value our customers and take pride in providing them with the most exciting entertainment services available in the hospitality industry today. In the course of providing credit and other financial services at the Casino, we obtain certain personal and financial information about our customers that we realize they may consider confidential. We know how much our customers value their privacy, and are therefore providing this notice to explain our policies for collecting and using this information. We collect nonpublic personal information about our customers from the following sources: information our customers provide on applications for credit and on other forms; information about our customer's transactions with us or with other companies; and information we receive about our customers from other sources, including credit bureaus, relating to their history and previous financial transactions. We restrict access to nonpublic personal information we collect about our customers to those employees, representatives, and agents who need to know that information to process credit applications, recover debt owed, or provide other products to our customers. We also maintain physical, electronic and procedural protections to guard our customers’ nonpublic personal information. We do not disclose any information about our customers or former customers to anyone except as permitted by law.
By signing this Credit Application, you certify as follows:
I certify that I am 21 years of age or older. I understand that persons under the age of 21 are not permitted to gamble. Accordingly, I must be 21 years of age or older to apply for credit at the Casino. I am aware that false misrepresentation of my age on this application subjects me to criminal prosecution.
I represent and warrant that I am applying for credit from Celebrity Cruises Inc. ("CCI") for my own personal gaming purposes and that any credit extended to me by CCI will be used only by me and only for that purpose. I agree not to hold CCI or CCI's affiliates, subsidiaries, shareholders, officers, directors, employees, representatives, or agents responsible or liable for the information released or their use of any such information. Before drawing on my line of credit, if granted, I agree to sign credit instruments (i.e., checks) in the amount of the draw. I authorize CCI to complete any of the following missing items on these credit instruments: (1) the name of the payee, (2) any missing amounts, (3) a date, (4) the name, account number, and/or address and branch of any banks and financial institutions, and (5) any electronic encoding of the above items. I acknowledge that you have the ability and intent to legally repay any advance of money at voyage completion or upon demand or presentment.
I agree that I am liable for the repayment of any and all credit that is extended to me by the CCI regardless of how or by whom such credit is used. I hereby irrevocably and unconditionally waive any claim or defense that I am not liable for the repayment of any portion of the credit that is extended to me for any reason, including, but not limited to, the allegation that such credit was used by, or for the benefit of another person, with or without the knowledge or consent of the CCI.
I authorize CCI, and its representatives and agents, to investigate and verify my credit and financial information and to conduct such other investigations as it deems necessary, including obtaining consumer reports, contacting financial institutions, and checking my consumer credit, employment, bank and gaming history in order to evaluate my credit application as well as to update and/or review my account to provide services requested by me, as necessary or as required by law, and to furnish information concerning my credit record to credit reporting agencies and others who may properly receive this information. I hereby authorize CCI, at its sole discretion, to apply any and all chips I may redeem first to the reduction of my outstanding credit balance, with the remainder, if any, to be returned to me.
I agree that this application and all credit issued pursuant thereto will be governed, construed, and interpreted pursuant to the laws of the State of Nevada and shall lie solely in that state. I agree that CCI or its affiliates or subsidiaries may litigate any dispute involving the credit line, the debt, or the payee in any court, state or federal, in Nevada. I submit to the jurisdiction of any court, state or federal, in the State of Nevada, as well as the jurisdiction of any other court where I reside. In the event of a collection action, I agree to pay prejudgment and post-judgment interest at a rate of 18% per annum plus all expenses and attorney's fees incurred by CCI or its affiliates or subsidiaries in collection of items owed, unless prohibited by Nevada law, and in such case at the highest amount permitted by Nevada law. I further represent that I have not been excluded from any gaming operation, nor have any of my privileges at any gaming operations been restricted, either voluntarily or by action of law.
Warning: For the purposes of Nevada law, a credit instrument is identical to a personal check and may be deposited in or presented for payment to a bank or other financial institution on which the credit instrument is drawn. Willfully drawing or passing a credit instrument with the intent to defraud, including knowing that there are insufficient funds in an account upon which it may be drawn, is a crime in the State of Nevada that may result in criminal prosecution in addition to civil proceedings to collect the outstanding debt.
